JASPERS Networking Platform website

 

Welcome to the JASPERS Networking Platform website. Please carefully review the following Terms of Use that govern the use of this website. Should you not agree to these Terms of Use, do not use this website, and do not provide or download any material on this website.

 

 1. Definitions

Administrator: The JASPERS Networking Platform administrators at the European Investment Bank, 100, boulevard Konrad Adenauer, L-2950 Luxembourg.

Parties: The Administrator and the User.

Public Area: The area on the Website which is available to all Users.

Registered User: The User that has been granted access to the Restricted Area on the Website.

Restricted Area: The area on the Website which is available to Registered Users only.

Terms of Use: These terms of use governing the use of the Website by the User.

User: The party accepting these Terms of Use, including Registered Users.

Website: The JASPERS Networking Platform website.

 2. Consent

2.1.  By accessing and/or using the Website or by accessing any document, material or other information found on the Website, the User is deemed to have agreed to full compliance and understanding of the Terms of Use. These Terms of Use are binding upon the Parties.

 

2.2. The Administrator reserves the right to amend these Terms of Use at any time without prior notice to the User by posting amended Terms of Use on the Website. The Administrator encourages the User to review these Terms of Use whenever accessing the Website. Continued use of the Website or its services constitutes acceptance of the changes to the Terms of Use. If the User explicitly objects to any changes to the Terms of Use, the Administrator is entitled to revoke his access rights.

 

2.3. The Website is owned and operated by the Administrator whose headquarters are at the European Investment Bank, 100, boulevard Konrad Adenauer, L-2950 Luxembourg. For any information on the Website and on these Terms of Use the Administrator can be contacted at the following email address: jaspersnetwork@eib.org.

 3. Restricted Area

3.1. The Website consists of a Public Area and a Restricted Area. The rights and obligations set out in this Article apply to the Restricted Area and Registered Users only.

 

3.2. Registration is required to access the Restricted Area.  A Request for registration shall be addressed to the Administrator in writing at the email address mentioned in clause 2.3. Requests for registration are subject to approval by the Administrator and the fulfilment of the conditions set out in clause 3.3 and 3.4.

 

3.3. The following groups/persons/persons or groups meeting the following conditions can request registration: 

(a)  members of JASPERS staff

(b) members of JASPERS Partners (EIB, EBRD, European Commission, including possible future Partners)

(c) members of Managing Authorities in JASPERS operations countries

(d) subject to JASPERS agreement, members of key beneficiaries and other relevant public bodies in JASPERS operations countries

(e) subject to JASPERS agreement, members of Managing Authorities and other relevant public bodies in other EU and pre-accession countries

 

3.4. The approval of a request for registration is subject to the provision of the following information to the Administrator:

(a)    Full name;

(b)    Position held in the respective institution/administration, and name of the institution/administration;

(c)    Email address;

(d)    Username;

(e)    Password;

 

3.5. The Registered User has to:

(a) provide accurate and complete information in accordance with clause 3.4 and keep such information updated;

(b) maintain the confidentiality of account and password in order to prevent unauthorised access; this includes but is not limited to the duty to take all necessary steps to keep password secure and to inform the Administrator without delay if it is being or could be used by an unauthorised third party;

(c) incur sole liability for any and all activities that occur under the created account, including but not limited to the content of his posts, and assumes all risks associated with the use of the Website;

(d) agree to provide contact details to the Administrator to be contacted for administrative and non-commercial purposes.

 

3.6. In accessing and using the Website, the Registered User must comply with the Terms of Use and shall not use this Website in a manner which is not proper for its purpose, in particular but not exclusively, by:

(a) posting, linking to or otherwise publishing any postings or content that is unlawful, threatening, abusive, libellous, indecent, infringes copyright or other rights of third parties (such as personal rights), or which contain any other form of illegal content;

(b) knowingly or negligently uploading or attaching virus-containing or corrupted files or any other programme that could damage data and destroy, interrupt or limit the functionality of any computer software or hardware or telecommunications equipment;

(c) posting, emailing or making available any content or use this Website in a manner that is hateful or discriminatory;

(d) engaging in spamming, “chain letters”, “pyramid schemes” or similar activity and shall not distribute items of advertising;

(e) impersonating any person or entity, or misrepresenting any affiliation with any person or entity;

(f) obtaining access to the Website without authorisation;

(g) restricting, inhibiting or preventing any other User from using this Website;

(h) obtaining access to any Registered User’s account and collect, store or disclose personal information, about other Users without their    consent, or for unlawful purposes;

(i) forging the origin of any posting or content;

(j) posting or otherwise publishing any postings or content unrelated to the Website or repeatedly post the same or similar content;

(k) using words or common colloquialisms which may be seem as offensive or obscene by other members;

(l) breaching public morality in its manner of use;

(m) harassing, stalking or threatening any User, third party, and/or Administrator.

 

3.7. The User hereby grants to the Administrator a worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any message the Registered User posts on the Website and/or to incorporate it in other works in any form, media or technology now known or later developed.

 

3.8. The Registered User may at any time request termination of its registration from the Administrator in writing at the email address mentioned in clause 2.3.  Upon termination the Administrator will remove all data and other stored personally identifiable information of the Registered User within 6 months.

 4. User’s Obligations

4.1.  In accessing and using the Website, the User must comply with the Terms of Use and shall not use this website in a manner which is not proper to its purpose, in particular but not exclusively, by:

(a)   knowingly or negligently uploading or attaching virus-containing or corrupted files or any other programme that could damage data and destroy, interrupt or limit the functionality of any computer software or hardware or telecommunications equipment.

(b)   obtaining access to the Website without authorisation.

(c)   restricting, inhibiting or preventing any other Users from using this Website.

(d)   obtaining access to any Registered User’s account and collect, store or disclose personal information, about other Users without their consent, or for unlawful purposes;

(e)   forging the origin of any posting or content.

(f)    breaching public morality in its manner of use;

(g)   harassing, stalking or threatening any User, third party, and/or Administrator.

 

4.2. The Administrator reserves the right to disclose any information deemed as necessary in order to satisfy any applicable law, legal process or governmental request.

 5. Intellectual Property Rights

5.1.   This Website contains copyrighted material, trademarks and other propriety information (collectively, “Intellectual Property”) including text, photos and graphics. The User may not modify, publish, transmit, display, participate in the transfer or sale, creative derivative work, or in any way commercially exploit the content of this Website without prior written permission of the Administrator and/or the right owner or except as otherwise expressly permitted under the law.

 

5.2.   Except for personal or non-commercial internal use, copying, modifying, reproducing in whole or in part, uploading, transmitting, distributing, licensing, selling, publishing or otherwise using any of the materials in any other way is prohibited without obtaining prior written permission from the Administrator and/or the right owner. The Administrator preserves the right to refuse the granting of such permission based on its sole discretion.

 

5.3.   The User acknowledges that he does not acquire any ownership rights by downloading any content from the Website, except for the rights of use and other rights expressly granted herein.

 6. Administrator’s Obligations

6.1.   The Administrator may, without compensation, use any ideas, proposals and/or submissions stored by a Registered User by means of posting, uploading, inputting, providing or directly submitting on the Website for the purpose of development and improvement of the Website.

 

6.2.   The Administrator reserves the right, in its sole discretion, to suspend, change, modify, add or remove portions of the content available on the Website at any time.

 

6.3.   The Administrator aims at minimising technical errors and malfunctions. Notwithstanding this, some data or parts of the information may have been created or structured in files or in formats that are not error-free. The Administrator cannot guarantee that the underlying files and formats used are error-free and will not cause the User’s systems to malfunction.

 

6.4.   The Administrator does not guarantee that the Website will always be available. Whilst the Administrator is committed to ensuring that the availability of the Website will be essentially uninterrupted, access to the Website and its services may occasionally be suspended, restricted or impeded to permit repairs, maintenance or the introduction of new services or facilities.

 

6.5.   The Administrator accepts no responsibility and expressly excludes liability for any problems, including, but not limited to, failure of performance, computer virus, communication line failure, alteration of content, technical inaccuracies or typographical errors, to the fullest extent permitted by law as a result of using the Website or any linked external websites.

 7. Disclaimer and Liability

7.1.    The Website may contain links to other websites and resources controlled or offered by third parties. The Administrator is not responsible for the contents, advertising, products and other materials made available on or through such websites. Under no circumstances shall the Administrator be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused to a User in connection with such websites.

 

7.2.   The Website may include publications with technical inaccuracies or typographical errors that may be corrected as they are discovered, at the Administrator’s sole discretion. These corrections and changes may be incorporated into the Website at any time at our sole discretion.

 

7.3.   The Administrator does not verify pre-emptively the information/materials posted by Registered Users on the Website, and cannot be held responsible for this information and materials. The Administrator does not therefore guarantee the accuracy, originality or quality of any posting and content that is misleading, untrue or offensive.

 

7.4.   It is not possible for the Administrator to fully and effectively monitor content and material submitted for possible infringement of third party rights. Notwithstanding this, the Administrator reserves the right, at any time and at its sole discretion, to remove content posted contrary to these Terms of Use and to terminate and deny access to the Website at any time, in particular if the User breaches any obligation arising from these Terms of Use. If a User believes that a posting or any other content may infringe his/her legal rights, the User shall notify the Administrator immediately.

 

7.5.   By submitting postings or content to the Website, the Registered User accepts full liability towards the Administrator for any claim, costs and expenses made against him arising out of any such postings or content published by the User that is or are in breach of these Terms of Use.

 

7.6.   Unauthorized use of this Website may give rise to a claim for damages and/or be a criminal offence.

 8. Data Privacy Protection

8.1.   To perform the registration on the Website, the User shall provide its full name, email address, username and personal password. This information will be collected during the registration process, and will require the Registered User's express consent. Once registered, the Registered User may add to his/her profile contact details and other personal information, on a strictly voluntary basis, he/she is also able to follow activities of other Registered Users and participate in online communities and discussions. The Registered User explicitly acknowledges and consents that the personal data described in this paragraph and paragraph 4 of Article 3, as well as other personal information voluntarily placed on the Website, as well as information provided while performing any activity on the Website will be accessible to all other Registered Users.

 

8.2.   All data provided by the Registered User will be treated by the Administrator as confidential, and stored and processed only for the purpose for which it was collected, in compliance with the requirements of Regulation (EC) 45/2001. In particular, personal data will not be passed on to third parties or published or made available for general access outside the Website without the Registered User's express consent or unless necessary to comply with a request by or for the conclusion or fulfilment of an agreement with that Registered User.

 

8.3.   When the Website is accessed, certain information about Users, such as internet protocol (IP) addresses, navigation through the Website, software used and time spent, may be stored by the Administrator or on its behalf.  This information will be used for Website traffic analysis only.

 

8.4.   To help the Website remember the User’s settings (such as language and other preferences), the Administrator sometimes places small data files on the User’s computer, known as cookies. The Website does not use them to identify a User personally or to collect any personal data for any other purposes. The User can at any time control and/or delete cookies.

 9. Termination

In the event of any violation of the User’s obligations as set out in the present Terms of Use, the Administrator is entitled to revoke the User's access rights without prior notice.

 10. Governing Law and Place of Jurisdiction

10.1. These Terms of Use shall be governed by the laws of Luxembourg.

10.2. The Parties hereby submit to the exclusive jurisdiction of the Tribunal d’arrondissement de Luxembourg.
